Trademark objection is the objection which is raised by the Examiner of trademarks in the Examination Report for which the mandatorily reply to be filed by the owner of the trademark or his/her representative.
There are so many reasons for which the department can raise the objection in the Examination report like: the trademark resembles from other existing trademark under section 11 of trademark act or the trademark shall be descriptive of goods/generic/laudatory/indicating quality or nature of goods under Section 9 of trademark act or any other objection raised by the Examiner under Trademark act.
WHAT IS THE DUE DATE OF FILING OF TRADEMARK OBJECTION?
When the trade mark application is objected, it is stipulated that a response should be filed within one month from the date of receipt of Examination Report.
NON FILING OF TRADEMARK OBJECTION
When the examiner raised the objection in Examination report and if the reply is not filed within prescribed time then the department update the status of trademark as ABANDONED which means the trade mark application is not in force.
Prepare reply of objection.
Send reply to owner for approval
Submit reply on ipindia.gov.in
Affix DSC of Attorney on application.
Submission of Application
Make payment (if any)
Download acknowledgement of reply.
