As per New Telecom Policy (NTP) 1999, Other Service Providers (OSP), such as tele-banking, tele-medicine, tele-trading, e-commerce etc will be allowed to operate by using the infrastructure provided by various access providers for non-telecom services. The Telecom Commission in May 1999, accorded in principle approval for registration of Call Centers, both International and Domestic, in the country under the above category. Later, services like Network Operation Centers and Vehicle Tracking Systems, were also added to this category. As per the Terms and Conditions formulated by the Telecom Commission in February 2000, these application Service Providers could take telecom resources from authorized Telecom Service Providers only and may not infringe upon the jurisdiction of other authorized Telecom Service Providers and they will not provide switched telephony. The Department of Telecommunication (DOT) will charge a processing fee of Rs.1000/- per case. From its inception, over 2500 cases have been registered under the OSP category till date.
Service providers in India involved in providing services like tele-banking, tele-medicine, tele-education, tele-trading, e-commerce, call center, network operation center and other IT Enabled Services, using telecom resources are required to obtain OSP Registration. 1. Only companies that are incorporated as a private limited or a limited liability partnership can apply for this form of infrastructure. 2. OSP can only take services from registered vendors 3. A network diagram associated with the telecommunication is needed to be submitted to the department of telecommunication. 4. The internet services to provide customer service should only be availed through a registered Internet Service Provider. 5. The company should provide a declaration associated with all of the legal provisions.
What is the Validity and Compliances of OSP Registration?
Once an OSP Registration is approved, the license is valid for a period of 20 years – unless otherwise expressly mentioned. To maintain compliance, each of the OSPs are required to submit an “Annual Return” to the DOT (Department of Telecommunication) mentioning the activities undertaken and the present status of the OSP. The annual return for OSP License renewal must be submitted with 6 months of completion of the financial year.
